As you read these Conditions, please note that:
We, our, ourselves and us means Mega Global Air Services (Maldives) Private Limited, trading as MEGA, flyMEGA, or Mega Maldives Airlines.
You, your and yourself means any person, except members of the crew, carried or to be carried in an aircraft pursuant to a Ticket (See also definition for Passenger).
Airline Designator Code means the two characters, or three letters, which identify particular air carriers.
Authorised Agent means a passenger sales agent who has been appointed by us or by another carrier, or by any person or entity with whom or which we have entered into an agreement for the sale of air transportation services, whether as public or private carriage. For the avoidance of doubt, any person who sells or offers for sale Ticket(s) on our services for private carriage, including a charter agreement, will be regarded as an Authorised Agent but only to the extent that it has authority to bind us into a contract of carriage with a Passenger on the terms and subject to conditions set out herein but in all other respects shall be contracting with the Passenger as principal and, as such, shall be regarded as Ticket Issuer for the purpose of these Conditions of Carriage.
Baggage means your articles, effects and other personal property necessary or appropriate for wear, use, comfort or convenience in connection with your trip. Unless otherwise specified, it includes both your Checked Baggage and Unchecked Baggage.
Baggage Check means those portions of the ticket which relate to the carriage of your Checked Baggage.
Baggage Identification Tag means a document issued solely for identification of Checked Baggage.
Checked Baggage means Baggage of which we take custody and for which we have issued a Baggage Check.
Conditions of Carriage means these conditions of carriage or another carrier’s conditions of carriage, as the case may be.
Conditions of Contract means those statements and notices contained in, or delivered with, your Ticket, identified as such and which incorporate these Conditions of Carriage by reference.
Convention means either of the Warsaw Convention or the Montreal Convention, as applicable.
Coupons means Electronic Coupon, Flight Coupon and Passenger Coupon as required.
Damage means: (i) the death or wounding of a Passenger, or any other bodily injury suffered by a Passenger, caused by an accidents on board the aircraft or during any of the operations of embarking or disembarking; and/or (ii) damage sustained in the event of the destruction or the total or partial loss of or damage to Baggage which occurs during carriage by air; and/or (iii) damage occasioned by delay in the carriage by air of Passenger or Baggage.
Days means calendar days, including all seven days of the week, provided that, for the purpose of notification, the day upon which notice is dispatched shall not be counted.
DBC legislation means EC Regulation 261/2004 or any other legislation which aims to define the rights of obligations of carriers and passengers in instances such as denied boarding, cancellation or delay.
Electronic Coupon means an electronic Flight Coupon for an electronic ticket held in our computer database.
Electronic Ticket means an itinerary and receipt, Electronic Coupons and any boarding document we have issued to you.
Flight Coupon means that portion of the ticket that bears the notation "good for passage and indicates the particular places between which you are entitled to be carried.
Force Majeure means any cause preventing us from performing any or all of our obligations which arises from or is attributable to acts, events, omissions or accidents beyond our reasonable control.
Itinerary Receipt means the document or documents issued to Passengers travelling on Electronic Tickets containing the passenger name, flight information and notices.
Montreal Convention means the Montreal Convention for the Unification of Certain rules relating to International Carriage by Air, signed at Montreal, 28 May 1999.
Our Regulations means rules, other than these Conditions of Carriage and Tariffs, published by us and in effect on the date of the commencement of carriage, governing the carriage of Passengers and Baggage.
Passenger means any person, except members of the crew, carried or to be carried in an aircraft pursuant to a Ticket. (See also definition for you, your and yourself).
Passenger Coupon means that portion of the Ticket which is so marked and which ultimately is to be retained by you.
SDR means a Special Drawing Right as defined by the International Monetary Fund. It is an international unit of account based upon the values of several leading currencies. The currency values of the Special Drawing Right fluctuate and are recalculated each banking day
Stopover means a scheduled stop on your journey, at a point between the place of departure and the place of destination.
Tariff means published fares, charges and / or related conditions of carriage on an airline filed, where required, with the appropriate authority.
Ticket means the document entitled "Passenger Ticket and Baggage Check" or the Itinerary Receipt delivered to the Passenger, in each case issued by us or on our behalf by the Ticket Issuer, and includes the Conditions of Contract, notices and Coupons.
Ticket Issuer means the person who issued your Ticket. For the avoidance of doubt, we shall be regarded as Ticket Issuer if and only if you purchase your Ticket directly from us. Otherwise, your Ticket Issuer shall be person from whom you purchased, and who issued you with, you Ticket(s).
Unchecked Baggage means any of your Baggage other than Checked Baggage.
Warsaw Convention means the Convention for the Unification of Certain Rules Relating to International Carriage by Air, signed at Warsaw, 12 October 1929, as originally drafted or as amended by one or more of the following:
The Warsaw Convention as amended at the Hague on 28 September 1955 ;
The Warsaw Convention as amended by Additional Protocol No 1 of Montreal (1975) ;
The Warsaw Convention as amended at the Hague and by Additional Protocol No 2 of Montreal (1975);
The Warsaw Convention as amended at the Hague and by Additional Protocol No 4 of Montreal (1975);
Guadalajara Supplementary Convention (1961)
These Conditions of Carriage apply to flights for which our name or Airline Designator Code is indicated in the carrier box of the Ticket, provided that Article 13 applies to our liability for Damage however it may arise.
If we have arranged for another carrier to perform any carriage on our behalf, and if there is any difference between our Conditions of Carriage and those of the other carrier the latter will prevail to the extent necessary or desirable for operational purposes provided however that our liability will continue to be governed by Article 13 of our Conditions of Carriage.
These Conditions of Carriage are applicable unless they are inconsistent with our Tariffs or laws applicable to the carriage being provided hereunder, in which event such Tariffs or laws shall prevail. If any provision of these Conditions of Carriage is invalid under any such applicable law, the other provisions shall nevertheless remain valid.
Except as otherwise provided in these Conditions of Carriage, in the event of inconsistency between these Conditions of Carriage and any of Our Regulations that are of a specific nature and dealing with particular subject, Our Regulations shall prevail. We assume that all Passengers have familiarized themselves and have accepted Our Regulations.
Where our air transport services are obtained as private carriage, the same shall be supplemented by the rules and regulations set out in the relevant private or charter agreement in effect on the date of Ticket issuance to the extent that we have incorporated them be way of reference or otherwise into the Ticket. In the event of inconsistency between any of these and these Conditions of Carriage, the former shall prevail.
3.1.1 We will provide carriage only to the Passenger named in the Ticket, and you may be required to produce appropriate identification.
3.1.2 A Ticket is not transferable.
3.1.3 You shall not be entitled to be carried on a flight unless you present a valid Ticket containing the Flight Coupon or Electronic Coupon for that flight and all other unused Flight Coupons or Electronic Coupons and the Passenger Coupon. In addition, you shall not be entitled to be carried if the Ticket presented is mutilated or if it has been altered otherwise than by the Ticket Issuer. Any enquiries about lost or incomplete Tickets should be addressed to the Ticket Issuer.
3.1.4 In the case of loss or mutilation of a Ticket, (or part of it), or non-presentation of a Ticket containing the Passenger Coupon and all unused Flight Coupons, upon your request, we will replace such Ticket (or part of it) by issuing a new Ticket, provided there is evidence, readily ascertainable at the time, that a Ticket valid for the flight(s) in question was duly issued and you sign an agreement to reimburse us for any costs or losses up to the value of the original Ticket, which are necessarily and reasonably incurred by us or another carrier for misuses of the Ticket. The Ticket Issuer may charge a reasonable administration fee for this service.
3.1.5 Where such evidence is not available or you do not sign such an agreement, the Ticket Issuer may require you to pay up to the full Ticket price for a replacement Ticket, subject to refund if and when the original issuing carrier is satisfied that the lost or mutilated Ticket has not been used before the expiry of its validity. If, upon finding the original ticket before the expiry of its validity, you surrender it to the carrier issuing the new Ticket, the foregoing refund will be processed at that time.
3.2.1 Except as otherwise provided in the Ticket, in these Conditions of Carriage or in applicable Tariffs, a Ticket is good for carriage only from the airport of departure to the airport of destination for the flight and date shown on the Ticket and shall remain valid for one year from the date of issue.
3.2.2 If you wish to change any aspect of your transportation you must contact the Ticket Issuer in advance. The fare for your new transportation will be calculated and you will be given the option of accepting the new price or maintaining your original transportation as ticketed.
3.2.3 Each Flight Coupon contained in your Ticket will be accepted for transportation in the class of service on the date and flight for which space has been reserved. If you fail to check-in or reach the boarding gate on time for any flight for which the Ticket has been issued for any reason beyond our control, your Ticket will be invalid and we shall be under no liability to you.
3.2.4 In the event of death of a Passenger en route, the Tickets of persons accompanying the Passenger may be modified by waiving the minimum stay or extending the validity. In the event of a death in the immediate family of a Passenger who has commenced travel, the validity of the Passenger's Tickets and those of his or her immediate family who are accompanying the Passenger may likewise be modified.
3.2.5 Any modification contemplated under this Article 3.2 will be subject to a change fee charged in accordance with Article [3.5.1].
The Ticket will not be honoured and will lose its validity if all the Coupons are not used in the sequence provided in the Ticket.
Our name may be abbreviated to our Airline Designator Code, or otherwise, on the Ticket. Our address shall be deemed to be the airport of departure shown opposite the first abbreviation of our name in the Carrier box in the Ticket.
3.5.1 Tickets may be refundable, changeable, or non-refundable according to the Ticket, Tariff, or Our Regulations. Changes, if allowed, may be subject to seat availability and to payment of a change fee, together with any difference in the fare paid by you for the flight at the time of booking and the prevailing fare for the alternate flight, on the date that such change is made. Similarly, any change to the Passenger’s name, if allowed by the fare conditions, will be subject to the payment of a change fee, together with any difference in the fare originally booked and the prevailing fare for such flight at the time that such change is made. Any enquiries about these changes should be addressed to your Ticket Issuer.
3.5.2Notwithstanding the foregoing paragraph, if we cancel a flight, fail to operate a flight reasonably according to schedule, fail to stop at your destination or Stopover destination or cease to operate a route, a refund may be given on the following basis:
184.108.40.206(i)if no portion of the Ticket has been used, an amount equal to the fare paid; or
220.127.116.11(ii) if a portion of the Ticket has been used, the refund will be not less than the difference between the fare paid and the applicable fare for travel between the points for which the Ticket has been used; in either case but subject always to the provisions of the Convention and any applicable DBC legislation and to any defences available to us therein, this being our upper limit of our liability to you. In any event, any and all enquiries or complaints regarding refunds should be addressed to your Ticket Issuer, who will also administer such payment, if and when due.
18.104.22.168 Any refund required under Article 22.214.171.124 may be paid in the same manner and the same currency you used to pay for the Ticket(s).
3.5.3 You should ensure that you have appropriate insurance to cover instances where you have to cancel your Ticket, or where you are unable to make your flight for reasons of Force Majeure.
4.1 Fares apply only for carriage from the airport at the point of origin to the airport at the point of destination, unless otherwise expressly stated. Fares do not include ground transport service between airports and between airports and town terminals. Your fare will be calculated in accordance with our Tariff in effect on the date of payment of your Ticket. Tickets issued for infants who are less than 2 years old on the day of travel and who do not require a separate seat are subject to the fare conditions for the Ticket and Our Regulations, however, all applicable airport taxes and fees relating to their carriage may apply to their Ticket, as per 4.2.
4.2 Applicable taxes, fees and charges imposed by government or other authority, or by the operator of an airport, shall be payable by you. Please be aware that for certain routings, certain taxes, fees, and charges may not be included in the fare and may be collected separately by the us, the airport or a governmental body. The taxes, fees and charges imposed on air travel are constantly changing and can be imposed after the date of Ticket issuance. If there is an increase in a tax, fee or charge shown on the Ticket, you will be obliged to pay it. Likewise, if a new tax, fee or charge is imposed even after Ticket issuance, you will be obliged to pay it. Similarly, in the event any taxes, fees or charges which you have paid to us at the time of Ticket issuance are abolished or reduced such that they no longer apply to you, or a lesser amount is due, you will be entitled to claim a refund.
4.3 Fares, taxes, fees and charges are payable in the currency of the country in which the Ticket is issued, unless another currency is indicated by the Ticket Issuer, at or before the time payment is made.
5.1.1 The Ticket Issuer will record your reservation(s). Upon request, the Ticket Issuer will provide you with written confirmation of your reservation(s).
5.1.2 Certain fares have conditions which limit or exclude your right to change or cancel reservations. You should check the conditions that apply to your fare and we accept no responsibility for your failure to do so.
5.1.3 If you have not paid for the Ticket(s) prior to the specified ticketing time limit as advised by the Ticket Issuer, we may cancel your reservation without any liability to you.
For certain flights we may provide the ability to select your seat in advance either free of additional charge or for a fee. We will endeavour to honour advance seating requests, but we cannot guarantee any particular seat, and you agree to accept any seat that may be allocated on the flight in the class of service for which the Ticket has been issued. We reserve the right to assign or reassign seats at any time. In the event we collected a fee for a particular type of seat, such as a bulkhead seat, and you are unable to occupy that seat, we will provide a refund of the fee or other form of compensation of similar or like value at our discretion.
We will try to ensure that special services requested by you when you make your reservation, such as religious or dietary meals, or wheelchairs from the airport check-in to the aircraft are available provided that any such requests have been relayed accurately to us by the relevant Ticket Issuer. Additional charges may be made to you for the provision of any such services. We will not however, be liable to you for loss, expense, breach of contract or other damage should we, for any reason, be unable to supply such previously requested service.
For operational reasons, we do not make any guarantees about the provision or availability of in-flight entertainment equipment and advertised programmes; advertised special meals or any other type of meals; or the availability of advertised or any other in-flight services.
6.1 You must have completed the check-in process sufficiently in advance of flight departure to permit completion of any Government formalities and departure procedures, and in any event not later than 60 minutes before the scheduled flight departure.
6.2 You must be present at the boarding gate not later than 15 minutes before the actual departure time.
6.3 We may refuse to allow you to board if you have not checked-in in time, fail to arrive at the boarding gate in time or appear improperly documented as set out in Article 12.2.
6.4 We will not be liable to you for any loss or expense incurred due to your failure to comply with the provisions of this Article.
In the exercise of our discretion, we may refuse to carry you or your Baggage if we have notified you in writing that we would not at any time after the date of such notice carry you on our flights or if one or more of the following have occurred or may occur:
7.1.1 you are more than 30 weeks into your pregnancy or are an unaccompanied minor below the age of 16, in each case measured by reference to the actual day of travel. In the case of a pregnancy, we reserve the right to require as a precondition to allowing you to board our aircraft that you produce documentary evidence in a form acceptable to us confirming your medical status and exact stage of your pregnancy.
7.1.2 such action is necessary in order to comply with any applicable government laws, regulations, or orders;
7.1.3 the carriage of you or your Baggage may endanger the safety, health, comfort or convenience of other passengers or crew;
7.1.4 your mental or physical state, including your impairment from alcohol or drugs, presents a hazard or risk to yourself, to Passengers, to crew or to property;
7.1.5 you are not on our blacklist but you have previously committed misconduct on one of our flights and we have reason to believe that such conduct may be repeated or before or after a Ticket has been issued to you we obtained credible information that you are on a warning list or blacklist by any aviation authority or industry association or another airline;
7.1.6 you have refused to submit to any security check;
7.1.7 you have not paid any applicable taxes or charges;
7.1.8 you do not appear to have valid travel documents, may seek to enter a country through which you may be in transit, or for which you do not have valid travel documents, destroy your documentation during flight or refuse to surrender your travel documents to the flight crew, against receipt, when so requested;
7.1.9 you present a Ticket that has been acquired unlawfully, has been purchased from an entity other than the Ticket Issuer, has been reported as being lost or stolen or is a counterfeit, or you cannot prove that you are the person named in the Ticket;
7.1.10 you have not used the Coupons in sequence, or you present a Ticket, which has been issued or altered in any way, other than by the Ticket Issuer or us, or the Ticket is mutilated.
7.1.11 we are requested to do so by the Ticket Issuer;
7.1.12 you fail to observe our instructions with respect to safety, security or reasonable operational requirements;
7.1.13 you have previously committed one of the acts or omissions referred to above.
Acceptance for carriage of unaccompanied children, incapacitated persons, pregnant women, persons with illness or other people requiring special assistance is subject to prior arrangement with us and shall be governed by Our Regulations. Passengers with disabilities who have advised us of any special requirements they may have at the time of ticketing, and been accepted by us, shall not subsequently be refused carriage on the basis of such disability or special requirements, unless such carriage is subsequently and reasonably determined to pose a risk or hazard to you, other Passengers, the crew, or property., Government regulations may apply to the transportation of such Passengers. Subject to any applicable laws, we may, at our discretion, levy a charge for the provision of these services. All or some of the requirements of Article 7.2 may not apply to Passengers with disabilities travelling on Coupons to or from the United States or to or from Europe. If you ask us we will tell you how the requirements may differ.
If we believe that the aircraft weight limitation or seating capacity would be exceeded, we will decide in our reasonable discretion and subject to the provisions of Articles 8.6.3 and 9.5 of these Conditions of Carriage and any applicable local laws which Passengers or articles shall be carried.
We will not be responsible for, nor have any liability in respect of, items removed from you or your Baggage by airport security personnel acting in accordance with international or government regulations, whether or not any such items are subsequently retained or destroyed by such airport / security personnel, or are passed by such airport security personnel to us.
Your Ticket may or may not allow for an amount of baggage, free of charge, subject to our conditions and limitations, which may be available on our website and other publications or on request from any Authorised Agent or your Ticket Issuer.
Subject to space availability and aircraft weight restrictions, we may accept carriage of your Baggage in excess of the free Baggage allowance that may be applicable to you. You will be required to pay a charge for the carriage of such excess Baggage.
8.3.1 You must not include in your Baggage:
126.96.36.199. items which are likely to endanger the aircraft or persons or property on board the aircraft, such as those specified in the International Civil Aviation Organisation (ICAO) Technical Instructions for the Safe Transport of Dangerous Goods by Air and the International Air Transport Association (IATA) Dangerous Goods Regulations, and in Our Regulations, which are available for inspection on request; or
188.8.131.52. items the carriage of which is prohibited by the applicable laws, regulations or orders of any state to be flown from, to or over; drugs or alcohol or any other items that are illegal to import or export on the route being flown; or
184.108.40.206. items which are considered by us to be unsuitable for carriage by reason of their weight, size, shape or character, or which are fragile or perishable; or
220.127.116.11. Animals, including birds and reptiles.
8.3.2 Firearms and ammunition are prohibited from carriage as Baggage. We may, at our discretion, accept firearms and ammunition for hunting and sporting purposes as Checked Baggage. Firearms must be unloaded with the safety catch on, and suitably packed. Carriage of ammunition is subject to ICAO and IATA regulations as specified in Article 18.104.22.168.
8.3.3 We may, at our discretion, accept weapons such as antique firearms, swords, knives and similar items as Checked Baggage, but they will not be permitted in the cabin of the aircraft.
8.3.4 You must not include in Checked Baggage money, jewellery, precious metals, computers, personal electronic devices, negotiable papers, securities or other valuables, business documents, passports and other identification documents or samples.
8.3.5 If, despite being prohibited, any items referred to in Articles 8.3.1 to 8.3.4 are included in your Baggage, we shall not be responsible for any loss or damage to such items. In addition, failure to comply with such requirements may result in severe criminal penalties being brought against you and you shall also be liable for any costs resulting from any disruption incurred by us as a result of you not complying with this requirement and we shall be entitled to refuse you carriage on any return or subsequent flight.
8.4.1 Subject to Articles 8.3.2 and 8.3.3, we will refuse to carry as Baggage the items described in Article 8.3, and we may refuse further carriage of any such items upon discovery.
8.4.2 We may refuse to carry as Baggage any item because of its size, shape, weight, contents or character, or for safety or operational reasons, or in the interests of the comfort and convenience of other passengers.
8.4.3 We may refuse to accept Baggage for carriage unless it is properly packed in suitable containers.
For reasons of safety and security, you and your Baggage may be searched by hand or by X-ray or other type of scan. If you are not available, your Baggage may be searched in your absence. If you are unwilling to comply with such a request we may refuse to carry you and your Baggage. In the event an X-ray or other scan causes damage or delay to you or your Baggage, we shall not be liable for such damage or delay unless due directly to our fault or negligence.
8.6.1 Upon delivery to us of your Baggage, which you wish to check, we will take custody of, and issue a Baggage Identification Tag for each piece of your Checked Baggage.
8.6.2 Checked Baggage must have your name affixed to it.
8.6.3 Checked Baggage will, whenever possible, be carried on the same aircraft as you, unless we decide for safety, security or operational reasons to carry it on an alternative flight. If your Checked Baggage is carried on a subsequent flight, we will deliver it to you, unless applicable law requires you to be present for Customs clearance.
8.6.4 Unless otherwise permitted in writing by the Carrier, passengers may check in baggage within the Checked Baggage Allowance as follows:

22.214.171.124 In addition to Maximum weight, total dimension of all checked baggage must not exceed 62 linear inches / 158 centimeters (length + width + height), the Permitted Size.
126.96.36.199 The checking-in of any item exceeding the Maximum weight and/or Permitted Size may be permitted and will be charged according to rates we have set from time-to-time.
188.8.131.52(i) A charge for the first 10kgs at the discretion of the check-in agent will be made in excess of checked baggage allowance provided such item does not exceed in any way the Permitted Size.
184.108.40.206(ii) Any item of Checked Baggage which exceeds the Permitted Size will be charged USD30 per piece or as set from time-to-time for each route.
8.6.5 Notwithstanding 220.127.116.11(iii), acceptance of any Checked Baggage larger and/or heavier than the Permitted Size will be solely at our discretion and in any event subject to prior approval and notification upon booking/reservation and may be subject to an additional charge, as per Our Regulations. You may repack overweight or oversize items or split into lighter units during check-in if there is enough time prior to the check-in cut-off time. Such items that cannot be repacked will not be accepted for carriage. In either case, we shall not be liable to you for any loss, damage or delay arising as a result of your failure to comply with the weight allowance and need to repack, split or decline to carry the overweight items.
8.7.1 Unless otherwise specified in writing by us, you may carry one small personal item (such as a purse, briefcase, handbag, or laptop computer) and one carry-on bag which must not be larger than 56x36x23cm or 22x14x9 inches (length x width x height) with a maximum combined weight of both items of 7kgs. Notwithstanding the foregoing, such items of Baggage must fit under the seat in front of you or in an enclosed storage compartment in the cabin of the aircraft and if either or both of your items of Baggage cannot be stored in this manner, or is of excessive weight, or is considered by us to unsafe for any reason, such item must be carried as Checked Baggage and additional charges may apply.
8.7.2 Objects not suitable for carriage in the cargo compartment (such as delicate musical instruments), and which do not meet the requirements in Article 8.7.1 above, will only be accepted for carriage in the cabin compartment if you have given us notice in advance and permission has been granted by us. You may have to pay a separate charge for this service and our liability may be limited.
8.8.1 You are required to collect your Checked Baggage as soon as it is made available at your place of destination or Stopover. Should you not collect it within a reasonable time, we may charge you a storage fee. Should your Checked Baggage not be claimed within four (4) weeks of the time it is made available we may dispose of it without any liability to you.
8.8.2 Unless we direct otherwise, only the bearer of the Baggage Check and Baggage Identification Tag is entitled to delivery of the Checked Baggage.
8.8.3 If a person claiming Checked Baggage is unable to produce the Baggage Check and identify the Baggage by means of a Baggage Identification Tag, we will deliver the Baggage to such person only on condition that he or she establishes to our satisfaction his or her right to the Baggage. We shall not be liable for handing over the baggage to an incorrect person if we made reasonable on-the-spot efforts to determine the person was entitled to the Baggage.
If you wish to travel with an animal you must advise us at the time of booking. Entirely at our sole discretion, we may agree to carry such animal at your request but subject to the following conditions:
8.9.1 You must ensure that the animal is properly crated and accompanied by valid health and vaccination certificates, entry permits, and other documents required by countries of entry or transit failing which, it will not be accepted for carriage. Such carriage may be subject to additional conditions specified by us, which may be available on our website or on request.
8.9.2 The animal, together with its container and food, shall not be included in your free Baggage allowance, but a handling fee shall be applied at the applicable rate.
8.9.3 If accepted, Guide or Assistance animals accompanying Passengers with disabilities will be carried for a nominal charge, subject to conditions specified by us, which are available for inspection on request. Note that the Maldives does not allow dogs of any type to enter the country.
8.9.4 Where carriage is not subject to the liability rules of the Convention, we are not responsible for injury to or loss, sickness or death of an animal which we have agreed to carry unless we have been negligent.
8.9.5 Subject to any applicable laws, we may refuse to carry your Guide or Assistance animal if any of the following has occurred or we reasonably believe that it may occur:
18.104.22.168 the animal has not been harnessed or muzzled appropriately;
22.214.171.124 we are unable to accommodate the seating of the animal such that it is in front of you;
126.96.36.199 the seating position of your animal would obstruct an aisle or other areas required by safety regulations to remain unobstructed for emergency evacuation purposes;
188.8.131.52 the animal engages in disruptive behaviour, or other behaviour that poses a direct threat to the health and safety of other passengers on the aircraft; or
184.108.40.206 there is insufficient evidence to prove that the animal has been properly trained and is a certified service dog.
8.9.6 Some or all of the requirements set forth in this Article may be modified or inapplicable in the case of Passengers travelling with service animals on Coupons to or from Europe and to and from the United States. If you ask us, we will tell you how the requirements differ.
9.1 We undertake to use our best efforts to carry you and your Baggage with reasonable dispatch and to adhere to published schedules in effect on the date of travel. However, to do so, we may need to use a substitute aircraft and/or the services of another carrier. We may also be obliged to change the time of flights, often for reasons beyond our control and consequently times shown in the Ticket, timetables or elsewhere cannot be guaranteed.
9.2 Except as otherwise provided by the Convention or any DBC legislation, if we cancel a flight, fail to operate a flight reasonably according to the schedule, fail to stop at your destination or Stopover destination, we shall, at our option, either:
9.2.1 carry you at the earliest opportunity on another of our services on which space is available without additional charges and, where necessary, extend the validity of your Ticket; or
9.2.2 within a reasonable period of time re-route you to the destination shown on your Ticket by our own services or those of another Carrier, or by other mutually agreed means and class of transportation without additional charge; or
9.2.3 procure that your Ticket Issuer consider giving you a refund in accordance with the provisions of Article 3.5. In any event, any and all enquiries or complaints regarding matters arising under this Article 9.2 including, without limitation, any delays, cancellations or possible refunds should be addressed to your Ticket Issuer.
9.3 Upon the occurrence of any of the events set out in Article 9.2, except as otherwise provided by the Warsaw Convention or the Montreal Convention, or, where applicable, any DBC legislation, the options outlined in Article 9.2.1 through 9.2.3 are the sole and exclusive remedies available to you and we shall have no further liability to you. In particular, except where any DBC legislation is applicable, if cancellations or delays are due to inclement weather or to air traffic control delays, we shall be under no immediate obligation to comply with Article 9.2.1 through 9.2.3 or to provide at all for the cost of telephone calls, accommodation, refreshments or transportation, although we shall make reasonable efforts to assist you as best we can in the prevailing circumstances.
10.1.1 If in our opinion, you conduct yourself on board the aircraft so as to endanger the aircraft or any person or property on board, or obstruct the crew in the performance of their duties or exercise of their rights during or after the flight, or fail to comply with any instructions of the crew (including but not limited to those with respect to smoking, alcohol or drug consumption), or behave in a manner which causes discomfort, inconvenience, damage or injury to other passengers or the crew, or act or encourage others to act to delay or disrupt the normal operation of the aircraft or the airline we may take such measures as we deem necessary to prevent continuation of such conduct, including restraint and diverting the aircraft to the nearest available suitable airport. You may be disembarked and refused onward carriage at any point, may be prosecuted for offences committed on board the aircraft, may be referred to or placed on a list of disruptive passengers, and we may take proceedings against you for recovery of any costs, expenses and liabilities incurred as a result.
10.1.2 If you and/or any other member of your party conduct yourselves in a manner described in the foregoing paragraph and/or if your Guide or Assistance animal engages in disruptive behaviour, or other behaviour that poses a direct threat to the health and safety of other passengers on the aircraft leading to us taking preventative actions as per the foregoing paragraph then you will indemnify us for all claims, liabilities, demands, losses, cost and expenses including without limitation all cost arising from the diversion of the aircraft for the purpose of offloading you and all losses suffered or incurred by us, our Authorised Agent and other agents, employees, independent contractors, other Passengers and any third party in respect of death, injury, loss, damage or delay to other person or to property, arising from your behaviour. In these circumstances we also reserve our right to apply towards such payment of such costs, the value of any unused carriage on your Ticket, or any of your funds in our possession. In addition, if you are refused carriage or offloaded from an aircraft because of your disruptive behavior, or that you are under the influence of alcohol or drugs or otherwise behaving in a disruptive manner, we may pass on your details and date of the refusal of carriage to other airlines for their information. This in turn may make it difficult for you to book other airline tickets.
For safety reasons, we may forbid or limit operation aboard the aircraft of electronic equipment, including but not limited to cellular telephones, laptop computers, portable recorders, portable radios, CD players, electronic games or transmitting devices, including radio controlled toys and walkie-talkies. Operation of hearing aids and heart pacemakers is permitted.
11.1 Subject to applicable law, if in addition to providing carriage by air, we also agree to make arrangements for the provision of additional services, we shall have no liability to you for such services except for negligence on our part in making such arrangements.
11.2 If we also provide surface transportation for you, other conditions may apply to such surface transportation. Such conditions are available from us on request.
12.1.1 You are responsible for obtaining all required travel documents and visas and for complying with all laws, regulations, orders, demands and travel requirements of countries to be flown from, into or through which you transit.
12.1.2 We shall not be liable for the consequences to any passenger resulting from his or her failure to obtain such documents or visas or to comply with such laws, regulations, orders, demands, requirements, rules or instructions.
Prior to travel, you must present all exit, entry, health and other documents required by law, regulation, order, demand or other requirement of the countries concerned, and permit us to take and retain copies thereof. We reserve the right to refuse carriage if you have not complied with these requirements, or your travel documents do not appear to be in order.
If you are denied entry into any country, you will be responsible to pay any fine or charge assessed against us by the Government concerned and for the cost of transporting you from that country. The fare collected for carriage to the point of denied entry will not be refunded by us.
If we are required to pay any fine or penalty or to incur any expenditure by reason of your failure to comply with laws, regulations, orders, demands or other travel requirements of the countries concerned or to produce the required documents, you shall reimburse us on demand any amount so paid or expenditure so incurred. We may apply towards such payment or expenditure the value of any unused carriage on your Ticket, or any of your funds in our possession. We may refuse carriage until the required payment is made, and this may entail your detention by relevant authorities until you have done so.
If required, you shall attend inspection of your Baggage, by Customs or other Government officials. We are not liable to you for any loss or damage suffered by you in the course of such inspection or through your failure to comply with this requirement.
You shall submit to any security checks by Governments, airport officials, and other carriers or by us.
12.1.2 You agree to hold us and our Authorised Agents harmless in relation to any losses or claims which may arise from transmission or retention of inaccurate data provided by you. If you fail to provide the necessary information prior to your departure, we may be unable to carry you to or through a country that requires the information and we reserve the right to cancel your reservation, without liability.
13.1.1 These Conditions of Carriage and applicable law govern our liability to you. Where other carriers are involved in your journey, their liability will be governed by the applicable law and, unless the Conditions of Carriage state otherwise, their Conditions of Carriage. Other carriers may have lower limits of liability.
13.1.2 Applicable law may include the Warsaw Convention and the Montreal Convention and/or laws which apply in individual countries. The Warsaw Convention and the Montreal Convention apply to international carriage as defined by them.
13.1.3 We will be liable only for Damage occurring during carriage performed by us, or in relation to which we have a legal liability to you. Where we issue a Ticket for carriage by another carrier, or we check-in your Baggage for carriage by another carrier, we do so only as agent for that carrier.
13.1.4 This Article 13 sets out the limits of our liability and summarises the liability rules applied by us under the Warsaw Convention and the Montreal Convention but if inconsistent with the Warsaw Convention and the Montreal Convention (where they apply) or other applicable laws, the Warsaw Convention and the Montreal Convention or such other applicable laws will override this Article 13.
13.2.1 There shall be no artificial limit to the amount of our liability for death, wounding or bodily injury suffered by a Passenger in the event of an accident on board the aircraft or in the course of embarking or disembarking.
13.2.2 For personal injury, we shall exclude or limit our liability to the fullest extent allowed in the applicable Convention.
13.2.3 We will defend ourselves if the Damage was not due to the negligence or other wrongful act or omission of us or our servants or agents, or that the Damage was solely due to the negligence or other wrongful act or omission of a third party.
13.2.4 We shall, without delay, and in any event not later than fifteen days after the identity of the natural person entitled to compensation has been established, make such advance payments as may be required to meet immediate economic needs on a basis proportionate to the hardship suffered, if required to do so by the applicable law.
13.2.5 An advance payment shall not constitute recognition of liability and may be offset against any subsequent sums paid on the basis of our liability, but is not returnable, except in the cases described in Article 13.2.3 or in circumstances where it is subsequently proved that the person who received the advance payment caused, or contributed to, the Damage by negligence or was not the person entitled to compensation.
13.2.6 We are not responsible for any illness, injury or disability, including death, attributable to your physical condition or for the aggravation of such condition.
13.3.1 Our liability for Damage to Baggage shall be subject to the limits prescribed in the applicable Convention, or in case of domestic carriage, to Our Regulations. We will not be liable for any Damage to Unchecked Baggage unless such Damage is caused by our negligence or the negligence of our agents.
13.3.2 We will not be liable for Damage to Baggage resulting from the inherent defect, quality or vice of the Baggage. Likewise, we will not be liable for fair wear and tear of Baggage resulting from the usual and normal rigours of transportation by air.
13.3.3 Where either the Warsaw Convention or Montreal Convention applies the limits of liability mentioned in 13.3.1 and 13.3.2 will not apply if you are able to prove that the Damage resulted from an act or omission by us or our agents done with intent to cause damage or recklessly and with actual knowledge that Damage would probably result and you prove that our employees or agents responsible for the act or omission were acting within the scope of their employment.
13.3.4 If you make a special declaration at check-in, and we accept it, and you pay any requisite fee, then our liability shall be limited to the higher declared value.
13.3.5 We are not liable for damage to baggage caused by delay if we prove that we and our agents took all measures that could reasonably be required to avoid the Damage or that it was impossible for us or our agents to take such measures.
13.3.6 We are not liable for any Damage caused by your Baggage. You shall be responsible for any Damage caused by your Baggage to other persons or property, including our property and shall be required to indemnify us accordingly.
13.3.7 We have no liability whatsoever for Damage to articles not permitted to be contained in Checked Baggage under Article 8.3, including fragile or perishable items, items having a special value, such as money, jewelry, precious metals, computers, personal electronic devices, negotiable papers, securities, or other valuables, business documents, passports and other identification documents, or samples.
13.4.1 We will be liable for Damage occasioned by delay in the carriage of persons by air in accordance with the requirements of the applicable Convention and subject at all times to our then prevailing delay compensation policy, as incorporated in Our Regulations.
13.4.2 The limits of liability stated in the applicable Convention or Our Regulations shall not apply if you prove that the Damage resulted from an act or omission of us, our servants or agents (acting within the scope of their employment), done with intent to cause damage or recklessly and with actual knowledge that damage would probably result, subject to any mitigation that may required of you by applicable law.
13.5.1 Any and all enquiries or complaints regarding matters arising under this Article 13 should be addressed to your Ticket Issuer.
13.5.2 We are not liable for any Damage arising from our compliance with or your failure to comply with applicable laws or Government rules and regulations.
13.5.3 Except as may be specifically provided otherwise in these Conditions of Carriage or by applicable laws, we shall be liable to you only for recoverable compensatory damages for proven losses.
13.5.4 The contract of carriage, including these Conditions of Carriage and exclusions or limits of liability, applies to our Authorised Agents, servants, employees and representatives to the same extent as it and they apply to us. The total amount recoverable from us and from such Authorised Agents, employees, representatives and persons shall not exceed the amount of our own liability, if any.
13.5.5 Nothing in these Conditions of Carriage shall waive any exclusion or limitation of our liability under the Convention or applicable laws unless otherwise expressly stated.
13.5.6 Nothing in these Conditions of Carriage shall waive any exclusion or limitation of our liability or any defence available to us under the Convention or applicable laws as against any public social insurance body or any person who is liable to pay compensation or has paid compensation in respect of the death, wounding or other bodily injury of a Passenger.
14.1.1 Acceptance of Baggage by the bearer of the Baggage Check without complaint at the time of delivery is sufficient evidence that the Baggage has been delivered in good condition and in accordance with the contract of carriage unless you prove otherwise.
14.1.2 If you wish to file a claim or an action regarding Damage to Checked Baggage, you must notify us as soon as you discover the Damage, and at the latest within seven (7) Days of receipt of Baggage. If you wish to file a claim or an action regarding delay of Checked Baggage, you must notify us within twenty one (21) Days from the date the Baggage has been placed at Your disposal. Every such notification must be made in writing and completion of a property irregularity report or questionnaire at the airport does not amount to sufficient notice of a claim.
Any right to Damages shall be extinguished if an action is not brought within two years of the date of arrival at destination, or the date on which the aircraft was scheduled to arrive, or the date on which the carriage stopped. The method of calculating the period of limitation shall be determined by the law of the court where the case is heard.
None of our Authorised Agents, servants, employees or representatives has authority to alter, modify or waive any provision of these Conditions of Carriage without our prior written permission.
16.1 Carriage of you and your Baggage is also provided in accordance with Our Regulations and certain other conditions applying to or adopted by us. Our Regulations as varied from time to time are important. They concern among other things; the carriage of unaccompanied minors, pregnant women, and sick passengers, restrictions on use of electronic devices on board the aircraft, forbidden items in Baggage, and the on board consumption of alcoholic beverages.
16.2 Copies of Our Regulations and conditions concerning these matters are available from us upon request.
